I am changing my textbook, can I scan and upload materials, like case studies, from the old textbook into my Blackboard?

While Fair Use allows individuals to make copies of small portions of a textbook for their personal use, it is not considered fair use to make small copies of a textbook and the provide access to those materials to others, even if it in a course management system.
If there is a small amount, one chapter or less than 10%, in the old textbook you would like to use for one semester, according to the classroom use rules, it can be scanned and uploaded into Blackboard for that one semester. For any subsequent use beyond that one semester, permission must be obtained by the copyright holder.
